got a little rust on top of my gas tank, Is there any problem in removing this rust and painting the tank? Does the oem tanks have a different type of metal ?

As long as there is no scale, or flakey rust a good scrub with a wire brush, blow it off, and a coat of Chassis Saver should fix it right up.

hey - thanks for the reply, sorry but I dont know for sure what you mean by "chassis saver"?
like any rust preventing paint ? like what I'll be using on the frame?

Chassis saver is a rust preventing paint with a sealer included that bonds to metal by special means better than paint can. Just be sure to read the instructions first, it is best to remove scale and leave the rust on the tank before application. Chassis saver converts the rust and bonds it with the paint to the metal, that is why it is better than regular paint.
Por-15 is also on the level as Chassis saver.

POR 15 is double the price of Chassis Saver, and its the same thing. They have no UV protection so I paint over them with a minimum of a spray bomb. They should be top coated within like 8 hours or so, Don't shake the can, stir only. If you get it on your skin clean it off with lacquer thinner or brake clean right away. If you don't it will be there for the better part of 2 months!
