Title: Girl Hit my Truck While it was Parked!! (pics)
Post by: Uno99 on July 01, 2008, 03:12:20 pm
:'(So I'm at work yesterday helping out a customer when I hear a THUD!!  I look out the window and see a young girl get out of her car.  I walked outside and she says "Do you know who's truck this is?"  I Replied yes it's mine.  Immediatly she starts in saying she doesn't want to report it to the insurance company.  I said I'm sorry but this isn't just a small ding here.  When the police arrive she actually said this is the 2nd parked car she has hit.  ???  WTH  So now I have to spend my next day off and get 3 estimates for their insurance company.  The thing that I am worried about is getting the paint to match. The truck has its original paint which is a bit faided but in really good shape for an 1981.  I'm not sure how its gonna look with new paint on the repaired area and older faded paint on the rest of the truck.

Neither am I but you know what the insurance adjuster will say. Well book value on your truck is only $1,200.00 so we'll give you that and you can say, see ya in court buddy.

gotta go with Vile on that...

My little brother was rear ended by a drunk driver a week before he left for boot camp. He has a 90 model k10 with only 80,000 on the odometer. The insurance company agreed to hold off on anything until he gets back from boot camp since he knows the truck and the damage better than anyone else does.

Some people should not have a drivers licensce!!!

That is what I was thinking. Should I have it appraised?

im sure it wont appraise at much looking like that lol lol

quick story: I had an 85 s10 with full air ride, custom paint, small block, you name it.  someone broke the glass out  of it (windsheild, side, rear, ex. cab glass) and insurance company was going to write it off.

We pay about 10 dollars a month extra on our show truck to repair/replace any and every add on part that gets damaged, regaurdless on factory or not, or value of truck. My mom's Mustang got rearended, and the insurance adjuster gave her a ridiculous quote, and totalled the car. She told them to replace the car with one just like it (1990 GT w/ 23,000 miles in 2000) and the could keep whatever they saved. Long story short, after paying for her rental car for 2 week, the check got larger, and was actually enough to buy a similar car. Stick to your guns, but read the fine print. The don't make all of their money honestly. She had insurance through them for 20 years, and never had a claim, and this was her thanks. She changed insurance companies needless to say... After they paid up, orf course

If it goes to court, fill out a warrant in debt for every little expense.  ie: time off work, rental for 1 week, fee for filing paperwork, etc..

Tell the insurance company that, and they'll listen.  They know that you mean business. Trust me.  They don't want to pay for their attorneys to go to court--that will be another expense for them.

My current insurance company would not even put comp on my truck because it is an 81.  I've been with them for 7 years with no claims.  I guess customer loyalty doesn't mean anything today.  Everyone is out to make a buck.

hey uno I can see you in the reflection  ;D. My buddy left his 69 gto in front of his house one night. First time he had ever done it. And wouldnt you know it, some teenage girl hits it, right in the front end. He blew up on her to say the least.

Oh man that sucks!  Was she driving with her eyes closed and using the Force?!?!?!

Don't know if this will make you feel any better (doubt it), but I recently pulled into a Starbucks with my '73 C20 pulling a U-Haul auto transporter trailer and parked to get some coffee.  A gal with her coffee walked past my truck and hopped into a mid-90's Mustang convertible (top down, so no blind spots), started it up and backed right into the trailer!  She said, and I quote "the trailer was so low, I didn't even see it".  She had walked right past it on the way to her car!  ???
I was glad I had paid the extra money for that U-Haul rental insurance coverage.

OK I need help here the insurance company only offer me $2090.  They made a check out to me in my name and said I can use it for whatever I want.  I advised I was not willing to accept that offer and the 2 estimates I got where for $2400 and $2900 I was told "well here is your check. If you don't agree just don't cash it and call our corporate office"  WTH.

I thought if it was the Bimbo's insurance they don't use your deductible that only comes into play when your insurance has to pay for your vehicle ..

True, talk to your insurance company and see what options they can give you as well against the other one. If your insurance agent is worth his salt, he will be able to steer you in the right direction.

I'll repeat what I posted earlier.  Trust me, I see this stuff everyday in court.  I had to do it as well years ago.   Take the largest estimate (here in VA, you only need one estimate--the largest of course) and add a week's rental car (call Enterprise rental or some place like that to get a quote).  If you lost any time off work, add that.

If you chose to consult an attorney- add that.   Add all things things together and come up with a figure.  Find out who the registered agent is for the insurance company--every company must have an RA registered with your state's corporation commission so that it can do business in your state. File a Warrant in Debt at your General District Court (or low court, or small claims, whatever your state calls it).  The defendant will be the insurance company, it will be served at the Reg. Agent of the corporation. There will be a court date.  Have pics of the truck before and after. Put that figure on the Warrant in Debt when you file for it at the court house. There will be filing fee--add that to the judgement request as well.

Once the insurance company see this Warrant in Debt came to their registered agent of their corporation, you will get a call and they will start to deal with you.  That is the only time they will start to deal with you.  Again, that is the only time they will start to deal with you.  They know you mean business. They don't want to incur the expense of the corporation attorneys, rental costs, loss of work costs, etc...

Small print...this is in no way legal advise.  I am not an attorney I just play one on a website.
