Disappointing news
« on: September 01, 2011, 12:33:50 am »
On June 28th I had my license suspended for 90 days because I had 2 moving violations before I was 18. Well, I turned 18 today and called the court to see if I could get my license back early. They said they had no record of it being suspended and to call DMV. I called DMV and they said the only way to get the auspension lifted is if the court exponges my record and my driving record. I called the court again and they said Arizona doesnt exponge records anymore. So im out of luck. And my license will still be suspended until September 28th.

you could hire an attorney.  They may advise whether they could get the courts to expunge your juvenile record....but, I'm sure your court date will be more than 30 days away.

I've never heard of juve driving records being expunged in VA.  Your driving record stays with you.  Can't hide from driving mistakes---insurance rates would be EXTREMELY high at that age and record.  I've heard many, many times when young dependents have been dropped from family policies due to their record.

In AZ, if youre under 18, after your permit you get a class G license, a Graduated license. And after you turn 18 you get a class D License, which is an actual Drivers license. With a class G, you have restrictions like these:

Quote
Graduated DRIVER LICENSE Requirements

    * Teen must be at least 16 years old.
    * Teen must hold the class G permit for at least six months.
    * Teen must have completed 20 hours of supervised, behind-the-wheel daytime driving practice and 10 hours of supervised, behind the wheel nighttime driving practice–a total of 30 hours–before applying for graduated driver license.
    * For the first six months, a teen with a graduated driver license cannot drive between the hours of midnight to 5:00am unless:
o A parent or legal guardian who has a valid driver license is sitting in the front passenger seat,
o The teen is driving to or from a sanctioned school sponsored activity, sanctioned religious activity, place of employment, or family emergency.
    * Teen with a Graduated Driver License shall not drive a motor vehicle containing more than one passenger under the age of 18 on a public highway, unless:
o The passengers are the teen driver’s siblings or
o The teen driver is accompanied by a parent of legal guardian with a valid driver license and occupies the front passenger seat.

And with a Class D license, you have standard driving rules.

With a class G license, your record goes off of Violations. An with a class D license your record goes off of the points system. I'm going to go into the Mesa Municipal court some time this week and request a hearing with a judge and see what he has to say. I have had my class G license since Feb. 22 and I'm hoping that the judge will lift the suspension since I am now 18 and give me a stander drivers license that uses the points system, Even if my points from my 2 previous violations transfer to my license, I just want to be able to drive.

at least its only 90 days.  I lost mine once for more than a year when i was 19..  though i was going WAY too fast (think almost 100mph over the speed limit)  in a 55 zone.  for some reason they didnt arrest me.  Im still surprised about that one.

Wow. I almost got a felont speeding ticket at 17mph over. 62 in a 45 trying to avoid a red light flash ticket. I down shifted and sped up to make the light. But I guess my truck is too fast, it jumped 12mph through the intersection and I got a speeding ticket instead of a red light ticket. Which is why I lost my license.

If you earned the punishment, be a man and accept the consequences for what you have done instead of looking for a loophole to get out of it. Whatever you do, don't drive while your license is suspended.

when i transferred my license from de to md my points didnt follow but i think if i was to transfer from md to de they would. but how did they catch you speeding? and not to be smart but our trucks just dont fly up 17mph in less than 4 seconds, stupid choice but you have to live with it

We have those Red Flex cameras all over town now, but hardly anyone pays the fines because they go against the states Constitution which says you have the right to face your accuser in court. It's a civil fine. not a criminal fine. It's a money maker for the city when someone pays. When you don't pay, they send you a nasty letter and then that's that.

i'm not trying to sound uppity or like i am a pedestal...BUT maybe i am wrong. i try my best to stop when the light turns yellow. something about accidents and wrecking my vehicles. and i was free to run 113 mph at the drag strip any time i wanted. and it was legal too!
let me just leave this idea with you...i work at a tissue bank. in simple english we cut up dead people and harvest bone/skin/tendons/misc. it would be fair to say at least 95% of donors under 25 are motor vehicle accidents.

maybe you'll be a little more careful?

well, people played that same role here in AZ, but the state and the city of Mesa is so money hungry that they have a representative for the radar flash tickets in court. This representative reviews the pictures from the camera, determines the driver, and charges them with the offense.

Irish, im not trying to make excuses, I accept full responsibility for driving over the speed limit. But  it was a fairly empty intersection, there is a lag time between lights, and I had some idiot in a civic talking on his phone riding my bumper. If I were to slam on my brakes, i would have been rear ended and left in the middle of the intersection. And I didnt say my truck accelerated by 17 in 4 seconds, but I was already a little over the speed limit plus my acceleration before the light. It was a horrible situation to get caught in. if I slowed down, I would have gotten a red light flash. If I sped up, I got a speed limit flash. If I stopped, I would have been in a wreck. It sucks, but its.my fault. Im a dumb kid and this is what happens when your dumb. I know. Besides, ive gotten by alright these past 2 months, so I think 25 more days wont kill me.

But! I do have good news! I get my license back on Sept 28th, I have to renew my registration, and re insure my truck(no reason for limited liability linsurance if its sitting) and on Sept 30th is the local Mud Bogs and Sand Drags. So ill be able to go to that again. And, ill probably have my uncles 79 K20 by then too!

Rob, after that incident and before I was served my suspension notice, I settle WAAAAYYY down. Because, I know my truck is better and faster than the others on the road who think theyre tough, so I dont have to prove it. And the sand drags is great to get my racing mentality taken care of. Thank you guys for attempting to make me drive safer. I have a lot of respect for the people who try to lead others in a better direction instead of saying "ya well next time I hope you wreck" or something stupid like that. So thanks everyone.

I'm not condoning careless driving by any means whatso ever. I have a wife, kids and Grandkids I woory about all thetime. Down here the setup is a scam however. I got a speeding ticket mailed to my house for 40 in a 35 on an empty street.  Yeah i should have paying closer attention to my speed I know. They set up these vans with radar and a camera.  They move them all over town so you never know where they are. It's pure Big Brother. Would a real cop stop you for going 40 in a 35? Probaly not unless it's a school zone witch it wasn't.
The redlight cameras are another story. It's all scam. They setup these redlight cameras and then they SHORTEN the yellow light. They have actually caused accidents in the past instead of preventing them just like the situation 1979C20 found himself in. Bottom line, drive as safely as you can. Just sometimes you get caught up in a situation, and 1979C20 you are not dumb. Just young. I was young once and did all kinds of stupid crap that I was lucky to live through. Just take things good or bad that happen to you and try to learn from them. AMEN

79 see you left the speeding part out before lol but anyway why i said 4 sec is because thats the time a yellow light stays yellow in a 45. if your not in the sold white lines at a intersection then you have time to stop in those 4 sec. if your inside of those lines when it hits yellow you have plenty of time to make it threw.
